Three feet is very close for a cherry tree as they get big in time.

A cherry tree will easily lift and crack a concrete path, but it is unlikely to damage a house, which has more solid foundations.

There is no right to light, but you can cut off anything, root or stem that crosses into your property.

Or try a charm campaign!
